Welcome to ID Card Maker. These Terms and Conditions ("Terms") govern your access to and use of the ID Card Maker mobile application (the "App") operated by BrightPen OPC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the App.

2. Description of Service

ID Card Maker is a mobile application that allows users to create, manage, and print professional ID cards. The App provides tools for:

• Managing organizations and projects.
• Designing custom ID card templates.
• Adding and managing member records, including photos and field data.
• Printing ID cards and tracking print history.
• Syncing data across devices.

3. User Accounts

To access certain features of the App, you must create an account. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You retain ownership of all content you create or upload to the App, including organization details, templates, member records, and photos ("User Content"). By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the App's services.

You are solely responsible for ensuring that your User Content:

• Does not violate any applicable law or regulation.
• Does not infringe the intellectual property rights or privacy of any third party.
• Is accurate and lawful, particularly when it includes personal data of other individuals (e.g., member photos and details).

5. Acceptable Use

You agree not to use the App to:

• Create fraudulent, misleading, or unauthorized identification documents.
• Violate any local, state, national, or international law.
• Harvest or collect personal information of others without consent.
• Interfere with or disrupt the App's servers, infrastructure, or other users' access.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Use the App for any purpose that is unlawful or prohibited by these Terms.

6. Intellectual Property

The App, including its design, code, graphics, logos, and underlying technology, is the property of BrightPen OPC and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or other proprietary elements without our prior written consent.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• The results obtained from using the App will be accurate or reliable.
• The App will meet your specific requirements.

8. Limitation of Liability

To the fullest extent permitted by law, BrightPen OPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the App.

9. Indemnification

You agree to indemnify and hold harmless BrightPen OPC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or your violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Chennai, India.
